Marjan’s practice focuses primarily on the defense of Class 1 Railroads,
and the prosecution and defense of corporate and commercial disputes,
unfair trade practice and competition cases, and litigation of personal
injury and insurance defense cases. He has actively practiced and
obtained numerous successful verdicts, summary disposition rulings, and
other similar results, before the State (Provincial) and Federal Courts
of Michigan, New York, Ohio and Ontario. His writing and litigation
presentation skills have been commended by the judiciary and peers
alike. Marjan’s recent accomplishments
include:
- Co-counsel in the successful prosecution
of a deceptive trade practices case under the Lanham Act and Ohio
Deceptive Trade Practices Act, for failure of a client’s competitor
to mark/label imported products with their country or origin
designation, resulting in Judgement of $1,150,000.00, plus all
associated attorney fees and costs (approximately $500,000.00). The
client was further protected by successful placement of a Permanent
Injunction against the violating importer. Appellate practice is
pending and once completed, in light of various issues recently
arising with products imported from the Peoples republic of China,
this case will provide the framework for prosecutions of many
similarly situated cases that will follow.
- Successful defense of a multi-million
dollar personal injury and property damage case, and prosecution of
a cross-collection action for property damage, resulting from a
grade crossing accident between a train and a semi-truck hauling a
multi-ton portable rock crushing plant. The client’s cross-claims
were settled in the amount of $510,000 for damage to locomotive and
property involved in the accident.
His past experience also includes serving as a
lecturer in economics with the University of Toledo, appearing as an
expert witness on international trade related issues before a Canadian
parliamentary subcommittee studying the effect of the North American
Free Trade Agreement on sport and culture in Canada, and providing
advisory opinions to various clients, including sub-national governments
and non-governmental organizations, on the potential effects of existing
and pending legislation on their interests.
Marjan is licensed and has actively practiced
in State (Provincial) and Federal courts in Michigan, New York, Ohio and
Ontario, Canada.
