Mr. Balcarczyk is of counsel to Anspach Meeks Ellenberger LLP. He concentrates his practice in civil litigation and devotes a substantial portion of his time to defending professional malpractice defendants, including nursing homes, hospitals, physicians, physician’s assistants, physical therapists, nurses and nurse’s aides.
Mr. Balcarczyk developed his expertise as a Partner at Damon Morey LLP, where he was a trial attorney in the Firm’s General Litigation Department. At Damon Morey LLP, he defended medical and nursing facilities and their staff against negligence and malpractice claims. He also represented medical professionals in misconduct proceedings involving the New York State Department of Health, Education Department and Office of Professional Medical Conduct. In addition, Mr. Balcarczyk has experience in the field of mental hygiene law, sports law and general liability.
Mr. Balcarczyk received his B.A. degree,cum laude, from the State University of New York at Buffalo in 1997, where he majored in Political Science and English, and minored in Spanish. He was a member of the Mortar Board National Honor Society and Golden Key National Honor Society. He received his J.D. degree from Albany Law School of Union University in 2001.
While at law school, Mr. Balcarczyk was an Associate Editor for the Albany Law Review. He served as the Judicial Intern for the Hon. Ralph W. Smith, Jr. – US District Court, Northern District of New York. He was also the Secretary for the Celtic Law Society.
Mr. Balcarczyk is a member of the New York State and Erie County Bar Associations, as well as the Western New York Defense Trial Lawyers Association and the Charles S. Desmond American Inn of the Court. In 2003, he was recognized for his commitment to the Volunteer Lawyers’ Project after completing over 150 hours of volunteer work. Damon Morey LLP received the distinguished “Large Law Firm Award” that year on account of Mr. Balcarczyk’s contributions.
Mr. Balcarczyk was born and raised in the Buffalo area and currently resides in the City of Lackawanna where he served as the Assistant City Attorney from 2013-2016. Mr. Balcarczyk was also an elected committee member for the City of Lackawanna from 1994-1996.
